2. Purpose

These terms of use and sale (the "Terms") set out how the DailyPull app is made available and the conditions for purchasing the digital content offered within it. Any use of the app implies full and unreserved acceptance of these Terms.

3. Description of the service

DailyPull is a mobile app for collecting and discovering inspiration cards and themed content. The app is available for download on the App Store (Apple) and Google Play. Some features and content are accessible for free; other content is offered through in-app purchases.

4. Access and use

The user agrees to use the app in accordance with its intended purpose and applicable law. It is notably prohibited to:

• attempt to circumvent the security or payment mechanisms of the app;
• reproduce, extract or redistribute the app content without authorization;
• use the app for unlawful purposes or in a way that infringes the rights of third parties.

JIXTER reserves the right to develop the app, modify its features or suspend access for maintenance or technical reasons.

5. In-app purchases

Some digital content in DailyPull is offered for sale as in-app purchases directly within the app. The applicable price is the one displayed in the app at the time of purchase, all taxes included.

Payments are entirely handled by the distribution platforms:

• App Store for Apple devices (iOS / iPadOS);
• Google Play for Android devices.

JIXTER has no access to any banking data of the user: billing, collection and payment management are the sole responsibility of Apple or Google, depending on the platform used. The purchase is concluded between the user and the relevant platform, in accordance with its own terms.

6. Right of withdrawal

In accordance with Article L221-28 of the French Consumer Code, the purchase of digital content supplied immediately after purchase makes it impossible to exercise the right of withdrawal, with your express consent and your waiver of that right. Refunds are handled directly by the App Store (Apple) or Google Play.

For any refund request, the user must therefore contact the platform that processed the payment directly:

• Apple: via reportaproblem.apple.com;
• Google Play: via the "Request a refund" help section of the Google Play Store.

7. Intellectual Property

All elements of the app (text, images, graphics, logo, card content, source code) are the exclusive property of JIXTER, unless otherwise stated. Purchasing digital content grants the user a personal, non-exclusive right of use, excluding any right of reproduction or distribution.

8. Liability

JIXTER strives to ensure the availability and proper functioning of the app. However, its liability cannot be engaged in the event of temporary unavailability, interruption or malfunction beyond its control, notably related to the distribution platforms or the user's network.

9. Personal data

The processing of personal data is described in the privacy policy.

10. Changes to the Terms

JIXTER reserves the right to modify these Terms at any time. The applicable version is the one in force at the date of use of the app or of the purchase.

11. Applicable Law

These Terms are governed by French law. In the event of a dispute, and failing amicable resolution, the French courts shall have sole jurisdiction.
